What should an employee do when something at work does not feel right? ARCH Legal Shareholder Hali Michelle Anderson recently joined the Partnerships for Profit podcast to discuss that question and provide insight into the workplace issues she regularly encounters.

In this episode, “What Every Employee Should Know About Workplace Rights,” Hali speaks with host Giovanna Rossini about her path to employment law. She shares how her background in sociology and social services led her to a field where she could continue working closely with people and helping them through difficult situations.

Hali began her legal career representing employers before moving to the employee side of employment law. During the conversation, she explains how that experience helps her understand the way employers and their attorneys approach workplace disputes. It also allows her to anticipate potential challenges and give clients a realistic picture of how their situation may unfold.

The episode addresses a concern Hali hears frequently from employees who believe they are being micromanaged or pushed out of their jobs. She discusses what employees can do in those circumstances, including keeping records of what is happening and considering whether the conduct may be connected to a protected characteristic or protected activity.

Hali also explains why unfair treatment is not always the same as unlawful treatment. Although an employer’s actions may seem unreasonable, a potential legal claim depends on the reason behind those actions and whether they violate an established workplace protection.

When evaluating an employment matter, Hali looks closely at the timeline. When did the workplace problems begin? When did the employee make a complaint? Were disciplinary actions already underway? She notes that emails, text messages, personal notes and witnesses can also help establish what occurred.

Employees should remain professional and follow the appropriate reporting procedures when raising workplace concerns. At the same time, Hali reminds listeners that human resources represents the employer. Consulting an employment attorney early can help an employee understand what to document, how to protect their interests, and what options may be available.

Hali also acknowledges how deeply workplace problems can affect someone’s life. Her role is not only to evaluate a possible claim but also to help clients understand the situation and make informed decisions about what comes next.
